Round-Up: "Sam Raimi’s 'Drag Me to Hell' feels like the director blowing off twenty years of steam," wrote critic Eric Kohn following a screening of the film at SXSW earlier this year. "The slapstick/horror duality that he mastered with his brilliant 'Evil Dead' movies, repeatedly and explicitly referenced in the new feature, marks a crowd-pleasing return to form. At once absurdly cheesy and amazingly self-aware, it’s a reminder of the lunacy that brought acclaim to Raimi in the first place." Indeed, serveral critics have noted that "Drag Me to Hell" is a welcome return to Raimi's roots since the director, after getting his start in comedy-horror, took some time off from the genre to direct the block buster "Spider-Man" trilogy. "At a time when horror is defined by limp Japanese retreads or punishing exercises in pure sadism, 'Drag Me to Hell' has a tonic playfulness that’s unabashedly retro, an indulgent return to Mr. Raimi’s goofy, gooey roots," notes Jeanette Catsoulis for the New York Times. "Swift and sure, 'Drag Me to Hell' unfurls in vertiginous, comic-book frames, like a long-lost issue of 'Tales From the Crypt.'" Also expressing satisfaction with the film are the LA Times' Betsy Sharkey who writes that the film "does everything we want a horror film to do: It is fearsomely scary, wickedly funny and diabolically gross, three stomach-churning states that argue for taking a pass on the $10 box of popcorn... Horror might not be your thing, but if you can push through the fear, stomach the gross and just let yourself go with it, the payoff is experiencing a filmmaker totally in his element" and the A.V. Club's Scott Tobias who says that the film "feels distinctly unburdened and fun, happily frolicking in its own pulp silliness... This is junk filmmaking at its finest." In other words, the critical consensus seems to be that Raimi's latest is a seriously entertaining thrill ride that does right by "Evil Dead" fans.

AYKM? Texting Improves Literacy


AYKM (are you kidding me)? No, contrary to popular belief, text message-speak or textisms actually improve language skills, according to a recent study. No, RLY (really).

The study, published in the British Journal of Developmental Psychology, studied 88 children aged between 10 and 12. The researchers, from Coventry University, gave the participants 10 different themes to write about using text messages.

The report, much to the delight of those who love to text, was mostly positive in terms of SMS. The report said:

"Children's use of textisms is not only positively associated with word reading ability, but it may be contributing to reading development."
Dr Beverley Plester, the lead author of the report added:
"The alarm in the media is based on selected anecdotes but actually when we look for examples of text speak in essays we don't seem to find very many. The more exposure you have to the written word the more literate you become and we tend to get better at things that we do for fun.

"What we think of as misspellings, don't really break the rules of language and children have a sophisticated understanding of the appropriate use of words."
Plester also authored a report in 2006 which noted that "those children who were the best at using textisms were also found to be the better spellers and writers." This new study just affirms the prior finding.

But besides her own studies, there are other such reports which have come to these same sorts of conclusions. Last year a study by an Australian psychologist showed that texting and textisms don't ruin a person's spelling ability.

And let's not forget linguistics expert David Crystal's book, Texting: The GR8 DB8, which concludes that texting actually makes people better at communicating, not worse. OMG.

Google Make Searching for "Me" More Personal, For a Price


I've done it before, and admit it, so have you. You've typed in your name into the Google search box, just to see what comes up. Starting on Tuesday, if you enter just the word "me" in their search box, users will be given an opportunity to create or modify their Google Profile, which Google says will help customize search results for your name.

To be clear, however, the prompt (shown above) which will appear at the top of your search results, will only display if you are not already logged into your Google account (or Gmail).

Here's what Google says:

To give you greater control over what people find when they search for your name, we've begun to show Google profile results at the bottom of U.S. name-query search pages. These results offer abbreviated information from user-created Google profiles and a link to the full profiles. We've also added links so it's easy to search for the same name on MySpace, Facebook, Classmates and LinkedIn.
But you can't just add a few tidbits. If you do, Google might tell you:
Your profile is not yet eligible to be featured in Google search results. To have your profile featured, add more information about yourself.
Yep, you had to add enough information so Google feels there's enough to add you to search results. Once you do, Google will give you the message:
Your profile is eligible to be featured in Google search results. You can find your profile at http://www.google.com/profiles/xxxx.

New York State's "Amazon Tax" Means the End is Nigh


As I filled out my California income tax this year, I laughed when I came upon the "Use Tax" section. Did I buy anything from out-of-state retailers that I owed California sales tax for? Of course I didn't! But whether or not I did, New York state is close to closing that loophole for its residents with the so-called "Amazon Tax."

Normally sales tax has depended on the retailer having a physical presence in a state. Of course, this would exclude Amazon.com, and be a real attraction to people who live in high sales tax states like New York (and California). Naturally states see this as a negative.

The new state budget would remove this loophole, and naturally is strongly supported by in-state retailers. The idea had been abandoned by then-Governor Eliot Spitzer last November, but was since resurrected. The budget was passed last week and is expected to be signed by current Governor David Paterson.

In a press release from January, the Retail Council of New York State said:

"Governor Spitzer’s proposal is a bold and necessary initiative that will help small retailers in New York State who today struggle to compete with Internet giants. These on-line merchants – none of which are based in New York – operate with an unintended competitive advantage fostered by a confusing sales tax landscape."
Of course, it's no longer Governor Spitzer, and it's also difficult to see how something like this isn't going to face legal challenges. In fact, in a 1992 Supreme Court decision, Quill vs. North Dakota, the Supreme Court ruled that out-of-state retailers cannot be required to collect sales tax on purchases sent to states where they did not have a physical presence.
The Supreme Court’s reasoning was at least partially based on the fact that, at the time the case was decided in 1992, there were over 6,000 separate sales and use tax jurisdictions in the United States (states, localities, special tax districts, etc.) and to impose a collection obligation on a remote seller would impose a crushing burden that would severely restrict interstate commerce.
Naturally, it could be argued that for an entity as large as Amazon.com, complexity as indicated above is a bogus argument. However, New York would require tax collections to be made if the entity had $10K in sales within the state. I think that's going to fail the complexity test because a small business could be forced, if this went nationwide, to keep up with the now over 7,000 sales tax laws across the country.

Still, eventually this loophole is going to be closed. And if the above NY proposal passes legal challenges, you can bet that my state, California, will jump on the bandwagon immediately.

Jury Selection by Software?

My wife recently made the final 12 on a jury. However, during the final round of questioning, she was removed from the jury by the defense, for cause. This made sense, as she's a psychologist and the case was about a repeat sex offender. On the other hand, what didn't make sense was that she got that far. She has some well-defined views on sex offenders, and she made no secret of them in earlier questioning. So how did she get so far?

Perhaps they were using JuryQuest. It's software that attempts to improve on the selection process.


That a computer program might become a vital tool in predicting juror bias is perhaps less surprising than the fact that it isn't already: The necessary mathematical formulas and attitude scaling techniques were developed by the early 20th century. To rate a jury pool, the program needs only seven pieces of information: age, sex, race, education, occupation, marital status, and prior jury service. Once entered, the program uses factor analysis to match the categories against a 4 million-item database built from survey questionnaires designed to identify authoritarian (prosecution-friendly) versus egalitarian (defense-sympathetic) bias. According to the article, attorneys are using the program in addition to their own intuition; kind of in the way the people might match themselves up on a dating website that uses questionnaires. Still, I cannot imagine why the defense would have let her get so far. It makes me wonder if anyone was paying attention.

We got our grubby mitts all over the latest and greatest from Sony Ericsson, including that new C905 8 megapixel monstrosity, and, of course, the Xperia X1. The C905 is certainly no slouch in the camera department, with that for-serious Xenon flash and dedicated camera keys, but you’ll pay for it in thickness — the C905 is a good deal thicker than its Walkman counterparts, though that does leave room for a nicely formed slide-out keypad. The C905 is capable of geotagging pictures, but can’t upload on the fly to photo services just yet like Nokia’s new phones, though such capability is in the works. While the C905 seems finely honed for a specific purpose, the Z780 flip phone seems much more plain jane in comparison, with a rather large size despite its “slim proportions” and a lack of detailing in styling to make it really pop.
