AMD, ATIC Investing $4.2 Billion for New York Semiconductor Plant

Mar 14, 2009

Advanced Micro Devices (AMD) and United Arab Emirates-based Advanced Technology Investment Company (ATIC) have formed a joint venture company that will build a $4.2 billion semiconductor factory in Malta, New York. A statement from Globalfoundries, the new company created by the partnership, says the New York chip factory will be named Fab 2 and is expected to create approximately 1,400 new direct jobs and more than 5,000 indirect jobs in the upstate New York region. The plant will use 32-nanometer (32nm) manufacturing technology to build chip circuitry that is approximately one-millionth of an inch across. Company officials say that once the plant is operational, it will be the only independently managed advanced semiconductor factory in the United States. The Albany Times Union reports that AMD was offered more than $1.2 billion in cash and tax breaks from the state in 2006, when the factory was first proposed and that Doug Grose, Globalfoundries' new CEO, says the company has until July 31st to notify the state of its plans for the build, at which time it can become eligible for those incentives.

Court Grants Rambus Supplemental Damages in Hynix Case and Orders Negotiation of Compulsory License

Denies Rambus request for injunctive relief

Los Altos, California, United States - 02/23/2009 - Rambus Inc. (Nasdaq:RMBS), one of the world’s premier technology licensing companies specializing in high-speed memory architectures, today announced that the U.S. District Court for the Northern District of California has granted its request for supplemental damages following an earlier jury verdict finding nine Rambus patents valid and infringed by Hynix SDRAM products. According to the order, Hynix is to pay Rambus royalties of 1% for SDR SDRAM products and 4.25% for DDR SDRAM products made, used, or sold in the United States after December 31, 2005. DDR SDRAM products include DDR SDRAM, DDR2 SDRAM, DDR3 SDRAM, GDDR SDRAM, GDDR2 SDRAM, GDDR3 SDRAM, and DDR SGRAM. These supplemental damages are in addition to those previously awarded in the amount of $133M for Hynix’s infringement through December 31, 2005.

While the Court denied Rambus’ request for injunctive relief, it did order Rambus and Hynix to negotiate the terms of a compulsory license to allow Hynix to continue to make, use, and sell SDR SDRAM and DDR SDRAM products.

“We are pleased with the Court’s order of supplemental damages,” said Tom Lavelle, senior vice president and general counsel at Rambus. “We believe any compulsory license between the two parties must fairly compensate Rambus for Hynix’s ongoing use of our patented inventions.”

The case with Hynix was originally filed by Hynix against Rambus in August 2000. Judge Whyte split the case into three separate phases with Rambus prevailing in all three phases. Cases are still pending against Hynix, Nanya, Micron, and Samsung in the Northern District of California.

Rambus stock tumbles on litigation postponement

Forbes (through AP) in Rambus shares tumble after judge halts patent suit noted:

Judge Ronald M. Whyte of the U.S. District Court for the Northern District of California postponed the trial until a separate appeal in the case is resolved.

Rambus stock price went down:

BWS Financial analyst Hamed Khorsand said the delay could last as long as long as two years. But he said he was surprised by the effect on Rambus's stock.

The issue in D. Delaware concerned litigation misconduct, not prosecution misconduct:

A Delaware court found last month that Rambus could not pursue the case against Micron because Rambus had destroyed evidence that it knew would be relevant at trial during or leading up to the suit.

DowJones noted: Rambus said that in a separate ruling, the California court denied Hynix's motion for summary judgment based on the Delaware ruling. The company also said that, "In an earlier case against Hynix, the California Court found that Rambus had not spoliated any evidence. Due to the conflicting opinions of these two courts, the California Court decided to stay further proceedings except for Hynix."
